New Jersey and New York rules cover a commission for referring any product or service, payments included.
- No commission on a client your firm audits or reviews, examines prospective financials for, or compiles statements for (New Jersey: any compilation accompanied by a report), or, in New York, performs any other attest service for (N.J.A.C. 13:29-3.12(b); 8 NYCRR 29.10).
- New Jersey wants the disclosure in writing at or before the referral, signed and dated by the client and by us (N.J.A.C. 13:29-3.12(f)).
- New York wants it on firm letterhead in 12-point type, naming the product, the provider, your relationship and the commission or its basis (8 NYCRR 29.10).
