Who We Are.
Batch Group LLC operates batchgroup.co and its divisions: Batch Capital, BatchOut, Batch Marketing, the Sub ISO Program and Batch Software. Each division contracts with you under its own legal entity, which is named in the agreement you sign with it. Batch Capital funding applications are currently handled by Onyxx Media Group LLC, doing business as Batch Capital.
By using this website or any service we provide, you agree to these terms. If you sign a separate agreement with a division, that agreement controls where the two differ.
What We Do.
- Batch Capital arranges business financing by presenting your application to independent funding providers. We are not the company that funds you, we do not make credit decisions, and submitting an application does not mean you will receive an offer. Any offer comes from the funding provider on its own terms, and the company funding your transaction is named in the agreement you sign with it.
- BatchOut helps businesses set up payment processing. The processor you are set up with, such as Square, provides the processing under its own agreement with you, and its terms govern your processing account.
- Batch Marketing provides marketing services under a written engagement that sets the scope, price and term.
- Referral partners are governed by the referral agreement they sign with the relevant division.
Using the Site.
- You must be 18 or older and using the site for a business purpose.
- Information you give us must be accurate and yours to give. If you submit information about a business, you confirm you are authorized to act for it.
- Do not interfere with the site, probe or scrape it, attempt to access accounts or data that are not yours, or use it for anything unlawful.
- If you are given an account on one of our portals, keep your sign-in private and tell us right away if you think it has been used by someone else.
Electronic Communications and Signatures.
When you give us your contact details, you agree that we may reach you by email and phone about your inquiry or account, and that notices we send electronically count as written notices. Text messages are sent only with your separate consent, under our Text Messaging Terms. You can unsubscribe from email with the link in any message we send.
Documents you sign through our electronic signature service, Batch Sign, are signed under the federal E-SIGN Act and the New Jersey Uniform Electronic Transactions Act. You consent to sign electronically each time you use it, and you can ask for a paper copy of anything you signed.
Calls May Be Recorded.
Calls with our team may be recorded and transcribed for quality, training and record keeping. Where the law requires it, you will be told at the start of the call.
Your Privacy.
How we collect, use and protect information is described in our Privacy Policy.
Our Content.
The text, design, logos and software on this site belong to Batch Group LLC or its licensors. You may read and share pages for your own business use. Do not copy, republish or sell our content without written permission.
Information on this site, including our guides and calculators, is general information, not legal, tax or financial advice. Figures such as rates, fees and timelines are examples or ranges and can change.
Third Parties.
We link to and work with other companies, including funding providers, payment processors and software vendors. We do not control them and are not responsible for their sites, products or terms. Your relationship with them is governed by their agreements with you.
No Warranty.
The site and our services are provided as is. We do not promise that the site will be uninterrupted or error free, or that any application will result in an offer. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of Liability.
To the fullest extent the law allows, Batch Group LLC and its divisions, officers, employees and partners are not liable for indirect, incidental, special or consequential damages, or for lost profits or revenue, arising from your use of the site or our services. Our total liability for any claim relating to the site is limited to the amount you paid us, if any, in the twelve months before the claim.
Indemnity.
You agree to defend and hold us harmless from claims and costs arising from information you gave us that was inaccurate or that you were not authorized to give, or from your misuse of the site.
Governing Law.
These terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Any dispute about the site or these terms will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction. A division's signed agreement may set its own venue, and that agreement controls for disputes under it.
Changes.
We may update these terms. We will post the new version on this page and change the date at the top. Using the site after a change means you accept it.
