Producer compensation rules in both states govern insurance transactions, and a business loan is not one.
- New Jersey's producer commission rules apply to producers selling commercial and personal lines insurance (N.J.A.C. 11:17B). They do not address a fee for a lending referral.
- New York's Regulation 194 disclosure rule is scoped to insurance transactions (11 NYCRR 30.2).
- Keep the two separate: never tie the financing to the purchase of a policy, and never make a policy a condition of the referral.
